Basic letter about determining the moment of death in the State law, by the Chief Rabbi of Eretz Yisroel the Gaon Rabbi Yitzchak Isaac Halevi Herzog to the activist R. Zerach Warhaftig. Jerusalem, 1952


In the letter, the Gaon Rabbi Yitzchak Isaac Halevi Herzog deals with the Presumption of Death Law which was enacted that year and presents to the renowned activist Mr. Zerach Warhaftig (then, the Deputy Minister of Religious Affairs and one of the leaders of HaMizrachi) the position of the Halacha on these complex issues which are implied by the Shas in several places. Between the lines, one can see Rabbi Herzog’s pain due to the fact that the law insufficiently takes into consideration the position of the Torah on such a basic and important issue ("… nevertheless, we are not even called to discuss it, since sadly and shamefully, to the law of succession of the State of Israel which is so dear to us – the law of Toras Yisroel does not count, unlike the Moslem law in our state"). The letter is typewritten and hand-signed by Rabbi Herzog who added several editings and corrections to the body of the letter.
